Terms of Service

These Terms of Service ("Terms") govern your access to and use of the websites, platforms, reports and services provided under the Scale9X brand ("Scale9X", "we", "us", "our"). The Scale9X brand and these platforms are operated by PT Indojaya Lakshmi Adisurya, a limited liability company incorporated in Indonesia, with its registered office at AXA Tower, Jl. Prof. DR. Satrio, Jakarta 12940, Indonesia.

By purchasing, accessing or using any Scale9X product or service, you agree to these Terms. If you are agreeing on behalf of a company or other organisation, you confirm that you have authority to bind that organisation, and "you" refers to that organisation.

1. What we provide

Scale9X provides business growth intelligence through two digital, browser-based products:

• Growth Diagnostic Platform — an online assessment that scores a company's growth maturity and potential and produces a diagnostic report.
• Growth Intelligence Platform — an AI-assisted executive process that produces a strategic growth blueprint.

We also offer advisory and delivery services (Growth Leadership, Execution Support and Revenue Sharing). Those services are provided under separate written agreements and are not sold through the online checkout.

2. Payments and Merchant of Record

Our order process and payments are conducted by our online reseller and Merchant of Record, Paddle.com Market Ltd ("Paddle"). Paddle is the merchant of record for all purchases, handles the transaction, issues the invoice or receipt, and is responsible for collecting and remitting applicable taxes. Paddle's own Buyer Terms also apply to your purchase. Prices are stated in US dollars; applicable local taxes are added at checkout based on your location.

3. Accounts and access

To use the platforms you must create an account with accurate information and keep your login credentials secure. You are responsible for all activity under your account. Access is granted to you and your organisation for your own internal business use, and only after the applicable fee has been paid.

4. Acceptable use

You agree not to: (a) use the platforms unlawfully or in breach of these Terms; (b) resell, sublicense or provide the platforms or reports to third parties as a service; (c) copy, reverse engineer or attempt to extract the underlying methodology, models or source; or (d) interfere with the security or operation of the platforms.

5. Intellectual property

The Scale9X platforms, the 9X Growth Model, our methodology, scoring, templates and the structure of our reports are and remain our intellectual property. On full payment, you receive a non-exclusive, non-transferable licence to use the deliverable produced for you (your diagnostic report or blueprint) within your own organisation. The business information you provide to us remains yours.

6. Nature of deliverables

Our diagnostics, blueprints and recommendations are professional analysis and informed opinion based on the information available to us. They are decision-support tools, not guarantees of any particular business, financial or growth outcome. You remain responsible for your own business decisions.

7. Confidentiality

We treat the business information you share with us as confidential and use it to deliver the service to you. Our handling of personal data is described in our Privacy Policy.

8. Disclaimers and limitation of liability

To the fullest extent permitted by law, the platforms and deliverables are provided "as is" without warranties of any kind. To the fullest extent permitted by law, our total liability arising out of or relating to the products or these Terms shall not exceed the amount you paid for the product giving rise to the claim. We are not liable for indirect, incidental or consequential losses, or for loss of profits, revenue or data.

9. Refunds

Refunds are governed by our Refund Policy, which forms part of these Terms.

10. Termination

We may suspend or terminate access if these Terms are breached. On termination, your right to use the platforms ends, though your previously delivered reports remain licensed to you.

11. Changes to these Terms

We may update these Terms from time to time. The current version, with its "last updated" date, always applies. Material changes will be reflected on this page.

12. Governing law

These Terms are governed by the laws of the Republic of Indonesia. The courts of Jakarta, Indonesia shall have jurisdiction, without prejudice to any mandatory consumer rights in your country of residence.
